To All,
I am of the opinion that if you get the proverbial "Bolt from the blue" than
perhaps the human may not be at fault. However if you take the same pilot
intentionally cruising at a flight level +/- 5000 feet of the freezing level
or near a thunderstorm then perhaps responsibility is his.
