I routinely guide the discussions to a decision dilemma for the PIC. I
then tell them that the crew needs to answer two separate questions during
the decision-making process: "Can" we do this, "May" we do this; the first
being aircraft and crew capability. If the aircraft is unable to perform the
event, the next question becomes easier. "May we do" refers to policy and
regulations.
Another "gut-check" question I encourage every crewmember to ask, in time
of confusion and uncertainity, is "Is this legal"?
Unfortunately, most of the discussions reveal a lack of Knowledge in the
"can" we do this arena; a function of experience among a young crew force.
In either case, before a PIC goes to his supervisor to seek permission for
violating P & R, the discussion proves useful.
"Can", and "May"; such simple ways for crews to answer "Is this Legal?"
